As reported in Law360, COJK successfully represented client Jingle Master International, Ltd. before the Patent Trial and Appeal Board (PTAB) in an inter partes review (IPR) proceeding involving a patent related to a liquid dispensing device. In 3BTech, Inc. v. Jingle Master International Ltd., the PTAB refused on August 23, 2019 to invalidate Jingle Master’s patent, claiming 3BTech failed to prove that the claim of the patent at issue was obvious. 3BTech challenged Jingle Master’s patent after licensee MercAsia accused 3BTech of patent infringement in Indiana federal court. In the federal matter, which is stayed pending the resolution of the IPR, MercAsia claimed 3BTech’s rival product infringed their patent for a fluid dispensing apparatus. The successful IPR allows MercAsia’s claim of patent infringement by 3BTech to proceed.
